Engineer Akulov rented a Moskvich car from a car limited liability company for the summer season. On the way to a place of rest on a narrow section of the highway, Akulov´s car collided with an oncoming car, as a result of which the car had a broken wing and a damaged headlight. The accident report stated that, in addition to the headlight and the wing, the engine was still damaged. Akulov agreed to refund the cost of repairing the headlamp and wing, but refused to refund the cost of the repair, because the damage indicated in the act was noticed at the time of the rental of the car, which Akulov verbally declared to the company’s employee, demanding that the car be replaced, but was forced to accept the faulty car due to the absence of another one.
